Biden Wants to Limit the Supreme Court
Joe Biden is preparing a proposal to make major changes to the Supreme Court, the Washington Post reported on July 16.
Biden told the Congressional Progressive Caucus in a Zoom call on Saturday:
I’m going to need your help on the Supreme Court, because I’m about to come out—I don’t want to prematurely announce it—but I’m about to come out with a major initiative on limiting the court. … I’ve been working with constitutional scholars for the last three months, and I need some help.
Proposal: The details of Biden’s proposed policies were not disclosed; however, they include two major changes:
- Term limits on justices
- An ethics code enforced by Congress
Term limits would mean the court would vacillate between Democratic and Republican majorities more frequently. An ethics code would mean the court would be unable to make a ruling without congressional approval.
Biden is also considering calling for a constitutional amendment to do away with presidential immunity, sources told the Washington Post.
Why? The Supreme Court recently made rulings in favor of President Donald Trump that have negatively impacted Biden and left-leaning Democrats:
- President Trump can remain on the 2024 presidential ballot.
- Jan. 6, 2021, protesters cannot be charged with obstruction.
- President Trump is immune from official acts.
Democrats not only disagree with these rulings, they are outraged by them. Many are calling the Supreme Court corrupt and its decisions an “assault” on democracy.
After Trump’s immunity ruling, Biden said:
This decision today has continued the court’s attack in recent years on a wide range of long-established legal principles in our nation, from gutting voting rights and civil rights to taking away a woman’s right to choose to today’s decision that undermines the rule of law of this nation.
Biden’s proposal is unlikely to be approved by the Senate, where Democrats have only a small majority. Even if it is approved, the changes will take time to implement.
