Supreme Court Lifts Order Blocking Deportations
The United States Supreme Court lifted a lower court order on Monday that blocked the Trump administration from using the Alien Enemies Act to deport Venezuelan gang members to El Salvador.
The court ruled 5 to 4 that the Trump administration could resume deportations, previously blocked by an order from U.S. District Judge James Boasberg, provided that the government give deportees “reasonable time” to challenge their removal.
Wartime law: The Alien Enemies Act is an 18th-century wartime law that allows the deportation of immigrants with little to no due process.
President Donald Trump enacted the law on March 15 to swiftly deport illegal migrants believed to be Tren de Aragua gang members. He was immediately opposed by Judge Boasberg, who placed a restraining order on the action until at least April 12.
An emergency request was filed to the Supreme Court on March 28 to review the pause after a D.C. Circuit Court of Appeals rejected a request to lift the block.
The Supreme Court has ruled in the Trump administration’s favor, allowing it to deport Tren de Aragua members.
