Supreme Court Receives Election Security Appeal
The Republican National Committee (rnc) asked the United States Supreme Court on Monday for an emergency order that could affect Pennsylvania’s vote count in the upcoming presidential election.
Why it matters: Pennsylvania is arguably the most important state in Tuesday’s election, and polls predict its race will be tight. It could majorly impact battles for the White House, Senate and House of Representatives.
Context: Last week, Pennsylvania’s Supreme Court ruled 4-3 that voters who make a mistake in their mail-in ballots will be allowed to cast a provisional ballot on Election Day.
However, the court’s ruling directly contradicts Pennsylvania law.
- Pennsylvania Act 77, passed in 2019, states, “A provisional ballot shall not be counted if … the elector’s absentee ballot or mail-in ballot is timely received by a county board of elections.”
The rnc asked the U.S. Supreme Court, which has already received three other election-related emergency order requests, to make a ruling by Friday.
Mail-in votes: Pennsylvania election boards have already received over 1.4 million postal votes, and hundreds of thousands more are eligible to vote by mail.
Generally, Democrats vote by mail more than Republicans. Earlier this month, numbers from Pennsylvania’s secretary of state showed that:
- 878,000 registered Democrats registered for a mail-in ballot.
- 371,000 registered Republicans registered for a mail-in ballot.
- 154,000 voters without registered political affiliation registered for a mail-in ballot.
- Large urban counties—typically Democratic areas—requested the highest number of mail-in ballots.
- Registered Democrats requested more mail-in ballots than registered Republicans in 55 of Pennsylvania’s 66 counties.
