Democrats Introduce Bill to Weaken Supreme Court
Democrats are introducing a bill to limit the power of the Supreme Court, which the Judiciary Committee will examine on July 20.
The Supreme Court Ethics, Recusal and Transparency Act was drafted by Rhode Island Democratic Sen. Sheldon Whitehouse. It gives the Supreme Court 180 days to establish a new code of conduct for justices and requires them to create an ethics committee of lower court judges.
Weakening the court: The nine Supreme Court justices are given lifetime tenure under the Constitution. They interpret the meaning of laws and how they should be applied.
Being appointed rather than elected protects them from being swayed by voters. That is not the case for members of Congress, who answer to those who elected them. The bill gives an open-ended invitation for ethics complaints against the justices, which would be handled by a five-member panel of chief judges from the circuit courts. Over time, such complaints would create the appearance of wrongdoing where there was none, delegitimizing the whole institution. The bill creates additional checks and balances that force the justices to base their decisions on popular opinion rather than law.
Politicizing the court: Democrats argue that the court is politicized. In reality, it will become politicized if this bill is passed. If the Supreme Court answers to judges from lower courts, it loses its power as the highest court in the United States. If no court is higher than the others, who upholds the Constitution? Who is the final authority guarding the law?
Texas Sen. John Cornyn said the Democratic legislation is “part of an effort to undermine public confidence in a court that they don’t agree with.”
The Supreme Court has recently come under fire for its rulings. Overturning Roe v. Wade, upholding the right to bear arms, upending racist affirmative action programs in colleges, renewing Title 42, and striking down Joe Biden’s student loan forgiveness are among the recent court decisions that have enraged leftists.
Will it pass? Ultimately, the Supreme Court will decide if it is constitutional for Congress to pass this bill, making it unlikely to pass. But putting the bill forward aids the Democrat’s agenda to destroy public confidence in the Supreme Court.
This legislation highlights the dangerous attitude the left has toward law. They don’t like the Supreme Court being supreme, so they attempt to subject it to their lower-level appointees.
